paying royalties on podcast music

Good day to you all. I would like to know the following: are any of you podcasters? Do any of you use commercial music in your odcast and if so are you required to pay royalties if the podcast is free? Do you have a music show for a podcast such as playing different comercial artists say perhaps a dance podcast? If so if the podcast is offered free do you have to pay royalties to any of the music orginizations ascap, bmi, and such? Thanks.

As long as you give credit to the artist you don't need to pay royalties.

I play it safe. My podcast is at www.gcast.com, who have some sort of partnership deal with garageband.com. So while these aren't huge names, you can get some great stuff there, and don't have to pay royalties. There are also other places where you can get podcast music from. On www.blindcooltech.com Mary Emerson mentions one in one of her casts which may be worth checking out.

I doubt it's a s simple as post 2 says since broadcasting isn't that simple. But I don't know the answer though I would imagine you have to.

Good morning and thanks for all this info. I would like to know the person who stated that giving credit to the artist is enough can you support this with any documents I can review? Since I am considering setting up an Internet station for our agency or more likely podcasts which would be much easier I want to be completely above board. I did research some of the laws and there are gray areas. I'd like to hear your views on this. Also, yes, I am using GCast and it's excellent for a host although I have not found any particular pod safe music I liked. What people at the agency want to do well, okay, a little back here. We have a closed circuit station and people do radio shows. Unfortunately the equipment is breaking down and I am trying to find a more affordable way to get do the shows and perhaps make them available as podcasts rather then live streams. So, being that much of the content is spinning music I need to be clear on my responsibilities. Thanks so much.
